Court Rules Against SEC: The United States Court of Appeals has ruled that the Securities and Exchange Commission was wrong in categorizing a new type of financial instrument as a security. The court said any financial instrument with characteristics of both a security and a futures contract falls under the jurisdiction of the Commodity Futures Trading Commission, not the SEC.
