Shareholder Files Suit Against With Design

A class-action lawsuit has been filed against With Design in Mind International Inc. in Chatsworth in connection with alleged embezzlement by the company’s two top former officers.
The complaint, filed in Superior Court in Los Angeles by a With Design shareholder, accuses the company and two former executives of violating federal securities laws.
With Design’s newly appointed president and chief executive, Sheldon F. Morick, said the complaint contains “numerous errors,” but did not elaborate. With Design also said it would move for dismissal of the shareholder lawsuit.
The toy and novelty gift company last month filed its own lawsuit against the two former executives, Steve Zuloff, With Design’s former chairman and chief executive, and Barry R. Benjamin, who was the company’s president and chief financial officer. Both men were ousted in late June after the company began an internal investigation. The suit accuses the men, along with Benjamin’s son, David S. Benjamin, of embezzling $2.1 million in various schemes that included fraudulent check cashing and diverting company funds for their personal use.
